Terms Of Service

Hello, there!
Thank you for your interest in commissioning me~ please kindly read these terms of service below before we start working together! (. ❛ ᴗ ❛.)

By commissioning me, you are agreeing to the following terms. Please read carefully before placing an order.GENERAL
• Payments will either be made through Paypal in EURO for international clients or paid in MYR through QR codes for local (Malaysian clients)
• Commissions are for Personal Use only unless commercial rights are purchased. (Additional fees apply depending on service.)
• My artwork may be used for personal display such as profile pictures, banners, posting on Socials with Credit, or printing for yourself, but may not be used for profit without prior agreement.
• AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs.
• I reserve the right to decline commissions outside my abilities or for subjects I will not draw.
• Communication is important. If I do not receive a response within 1 week, I will proceed and deliver the artwork as is.
• You receive 2 free revisions (sketch stage only). Additional revisions cost €5/5MYR each, paid before I continue. Please provide all feedback at the sketch stage.
• I do not deliver my working files.PAYMENTS & FEES
• All payments are upfront in full through the agreed platform.
• Payments to proposals should be paid fully within 2 weeks or will be declined.
• A Non-Disclosure Agreement (NDA) fee of €100/100MYR applies if you request that I do not post your commission publicly or use it as part of my Portfolio.
• Complexity Fee is between €10-50/10-50MYR for all Commissions.
• Primary use for resell of the illustration in commercial use incurs a fee of 200% of base price. (Stickers, posters, wallpaper)
• Commercial use whereby the artwork is used to support/promote another product, service or project where the artwork is not the primary item being sold incurs a fee of 50-100% of the base price. (Book cover, album cover, packaging, promotional material etc.)REVISIONS
• A max of 2 free revisions is allowed where there are minor changes
• Major revisions will have an additional charge of €5/5MYR
• Revisions are only available during the sketch phase.
• Once sketches are approved, no further changes will be made unless due to an error on my part. Mistakes I make will always be corrected at no cost.DEADLINES AND DELIVERY
• Commissions may take up to 1 month depending on complexity, queue, health, school, or personal matters.
• I will keep you updated if delays occur.
• If you wish to skip the Queue and be Priority, the fee will be €10/10MYR. You will have to Directly Message me or state in the Request forms that you wish for a Rush Fee.LIABILITY
• The Artist is not liable for any loss, damage, or injury resulting from the use of the commissioned art work
• The Client agrees to indemnify and hold the artist harmless from any claims, damages, or expenses arising from the Client’s use of the artworkINTELLECTUAL PROPERTY RIGHTS
I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.
I may use the artwork to:
• Promote myself and my services.
• Post on social media and in my portfolio.
• Create prints/merchandise (for fanart commissions only).
Exceptions:
If an NDA was purchased, the artwork will not be posted or used for promotional purposes.REFUNDS
• I may cancel and refund a commission at any time.
• You may cancel before payment is made.
• Once payment is received, refunds are not available.
• Chargebacks are strictly prohibited.
Filing a chargeback will:
• Forfeit your rights to use the artwork.
• Place you on a public blacklist (with evidence).
• Allow me to resell or reuse the artwork as I see fit.
• Result in a formal complaint against you.COMMISSIONER RIGHTS
You may:
• Use the artwork for personal purposes only (unless commercial rights are purchased).
• Print the art for yourself.
• Post it on social media with credit to me "@NuttyLava ".
You may NOT:
• Use the artwork commercially without permission.
• Commission art/services using my Design/Work.
• Claim the artwork as your own or fail to credit me.
• Remove signatures/watermarks.
• Resell or redistribute the artwork.
• Modify the artwork without my consent.
• Use artwork purchased for Personal Use in merch, streaming, or commercial projects.BLACKLIST POLICY
• Breaking these rules may result in a permanent public blacklist (with evidence).
• The blacklist may be shared with other artists.FINAL AGREEMENT
• By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.
